I. Scope

The following general terms and conditions apply exclusively to the business relationship between us and the customer for orders via this online shop in the version valid at the time of the order.

II. Product Description

Images and photos in our online shop are for illustration only. They do not always represent the item in a lifelike manner, but are used for illustration purposes. Depending on the screen used, colors and sizes in particular can be displayed differently. Only the content of our product descriptions is decisive.


III. conclusion of contract

Our internet offer is not an offer in the legal sense but an invitation to an offer. With your order with the button "Order with obligation to pay" you make a binding offer to conclude a purchase contract.

Before sending the order, you can view, change and delete the order data at any time. You can empty the shopping cart with the "Delete shopping cart" button.

Immediately after sending your order, you will receive an e-mail confirming its receipt (confirmation of receipt). The acceptance of your order and thus the conclusion of the contract takes place through the delivery of the ordered goods.

We would like to point out that your order data will be saved by us, but can no longer be accessed by you after you have placed your order. However, the confirmation of receipt contains all the details of your order. Orders can only be placed in German.


IV. Delivery

1. We deliver worldwide.

2. The delivery takes place with a minimum order value of 20.00 €.

3. We supply resellers on special terms, which can be requested from info@mogadorshop.com.

4. The delivery of the goods will be initiated immediately after receipt of the order. Our standard delivery time within Germany is 2 to 5 working days for goods that are in stock. In the case of orders against advance payment, the goods will only be delivered after we have received the full payment. As a result, the delivery dates can be postponed. We do not reserve the ordered goods until full payment has been received. If the goods are sold out at the time of full payment and have to be ordered again, we will inform you immediately.

5. If the goods are temporarily no longer available or no longer available due to non-availability, we will inform you immediately. We will immediately refund services already rendered.


V. Shipping costs

1. Within Germany per order: 2.5 € from 25 € order value free shipping. If necessary, the current price applies, which is shown on the shipping costs button.


VI. Pricing information

All prices quoted include the statutory value-added tax. The prices also include all other price components apart from the additionally specified shipping costs.


VII. Payment options

You can choose between the following payment methods:

1. Within Germany:

The payment methods offered on the payment methods button apply. We reserve the right to offer one of the following payment methods:

a) Purchase on account
You order your desired goods and we will send you the invoice together with the ordered goods. Please use our specified account details for payment. Pay the invoice within 14 days after receipt of the goods.

c) Payment via PayPal
You select PayPal as the payment method during the ordering process and after your order you will be forwarded to the PayPal website, where you can complete the payment. You will then receive an email from PayPal confirming your payment.

2. Outside of Germany, delivery is generally only made against prepayment. The goods will be delivered after full payment has been received on our bank account named below or our PayPal account buchhaltung@mogador-argan.com.

Customers from the EU internal market will not incur any additional foreign transfer costs when using the new EU foreign transfer form when stating their IBAN and BIC. Customers from the other countries have to pay all bank fees in full.


VIII. Right of Withdrawal

You can cancel your contractual declaration within 14 days in text form (e.g. B. letter, fax, e-mail) or - if the item is given to you before the deadline - also revoked by returning the item.

The timely dispatch of the cancellation or the item is sufficient to meet the cancellation deadline. The revocation must be sent to:

Consequences of revocation

In the event of an effective revocation, the services received by both parties are to be returned and, if necessary, drawn uses (e.g. B. interest). Can you tell us the service received and uses (e.g. B. Benefits of use) or only partially or only in a deteriorated condition, you must pay us compensation in this respect. You only have to pay compensation for the deterioration of the item and for any use made if the use or deterioration is due to handling of the item that goes beyond the examination of the properties and functionality. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your declaration of revocation or the item, for us with their receipt.

Shipments without freight prepaid will not be accepted!

In the event that we are obliged to bear the cost of the return shipment, we may send you a DHL parcel sticker (Freeway brand) prepaid by us. Stick this on the package and send the well-packaged goods back to us. You are welcome to contact us by telephone, e-mail, post or fax in this regard.

IX. retention of title

The goods remain our property until full payment.


X. Warranty

The statutory warranty provisions apply. If the goods you have ordered are used for your own commercial or self-employed professional activity, your claims under the statutory warranty provisions become statute-barred in one year. Any guarantees from the respective manufacturer or from us leave the guarantee unaffected.

XII. Pictures and texts in our online shop

All images and texts in our online shop are subject to copyright and other laws protecting intellectual property. They may not be copied, modified or used on other websites for commercial or distribution purposes.

XV. Final Provisions

1. German law applies to the exclusion of the UN purchase law.

2. The place of jurisdiction for business transactions with merchants is the District Court of Reutlingen. We are also entitled, at our discretion, to sue at the customer's registered office.

3. If a provision of these GTC is or becomes ineffective, the rest of the GTC shall remain effective.
